Funding your trust means that you have transferred the title of your assets from your name to the trust. Your residence, for example, should be transferred into the newly created trust.

Failure to transfer title prior to your death could mean that the assets will still have to pass through the probate process. In order to avoid probate, your assets should be titled in the name of your trust.

It is important to periodically review your estate planning documents and your assets:

  • To determine whether any changes are necessary to your documents
  • To determine whether all of the assets that should be held in your trust have been actually transferred to the trust.
